Producers
“Producer” according to article 7 point 14 of the Law on management of electric and electronic equipment and waste electrical and electronical equipment (Official Gazette of RSM No. 176/21) means any natural or legal person who, irrespective of the selling technique used, including sales by means of distance communication in accordance with regulations governing consumer protection:
- is established in a Republic of North Macedonia and manufactures EEE under his own name or trademark, or has EEE designed or manufactured and markets it under his name or trademark within the territory of the Republic of North Macedonia;
- has its headquarters in the Republic of North Macedonia and resells in the territory of the Republic of North Macedonia, under its own name or trademark, equipment produced by another producer, with the reseller not being considered a producer if the brand of the original producer is indicated on the equipment;
- has its headquarters in the Republic of North Macedonia and, due to the performance of its activity, imports equipment for the purpose of placing it on the market in the Republic of North Macedonia or exports equipment outside of it. A producer who, as an end user, has imported equipment without an intermediary for his own needs, as well as a legal or natural person who imports used equipment and places it on the market in the Republic of North Macedonia, will be considered as a manufacturer;
- is established in another country and sells equipment via distance communication directly to households or other users other than households in the Republic of North Macedonia
A producer shall not be deemed to be a person who provides only financial support under or pursuant to any financial arrangement unless he is acting as a producer within the meaning of the foregoing.

A producer shall not be deemed to be a person who provides only financial support under or pursuant to any financial arrangement unless he is acting as a producer within the meaning of the foregoing.

Legal obligations of the Producer
- Producers who for the first-time place on the market or import as end users’ equipment for their own needs in the Republic of North Macedonia, are obliged to register for this with the State administration authority responsible for performing professional work in the field of the environment;
- Registration is performed by submitting a request for registration, by the manufacturer to the State administration authority;
- The producer of the equipment and the producer of the materials and component parts of the equipment are obliged to take measures and activities during the planning, design and production of the equipment to ensure: reduction of the use of hazardous substances, easier disassembly and dismantling, reuse, recycling or otherwise processing the waste equipment, its components and incorporated materials;
- The producer is obliged to provide a clearly visible, legible and indelibly displayed mark for the separate collection of waste equipment in a visible place on the equipment he places on the market;
- The producer is obliged to take care of the waste generated after using the product;
- The producer is obliged to provide and organize a system for the collection of waste electric and electronic equipment from households where the return reception and collection of waste equipment from households is carried out in such a way that the end users and the trader who collects the waste equipment from households will return it free of charge in order further handling and achieving the goals for collection and the goals for the processing of waste equipment;
- The producer is obliged to cooperate with the trader in whose premises the products that he has places on the market are placed in order to take joint measures aimed at encouraging the collection of waste products from end consumers, as well as to provide equipment for the separate collection of waste that is created from the waste products, for the purpose of their reuse, processing or recycling of the special waste stream and thereby achieving the national goals;
- The producer is obliged to ensure regular collection of waste equipment from households by the trader so often that waste equipment does not accumulate;
- In order to achieve the national goals, the producer, independently or through a collective scheme, is obliged to cooperate with the municipalities, the municipalities in the city of Skopje and the City of Skopje and the regional systems for waste management in order to undertake joint measures aimed at encouraging the separate collection of waste products, as well as to establish collection centers and other infrastructure for the separate collection of waste products and separate waste streams for the purpose of reuse, processing and recycling of the separate waste stream.
Categories of electrical and electronic equipment to which the manufacturer's obligations apply:
Category 1: Temperature exchange equipment
Category 2: Screens, monitors and equipment that have screens with an area greater than 100 cm2;
Category 3: Lamps
Category 4: Large equipment
Category 5: Small equipment
Category 6: Small information and communication technology and telecommunication equipment
Types of equipment that fall into the appropriate category
Category 1
refrigerators, freezers, air conditioners, heat pumps
Category 2
Screens, TVs, LCD photo frames, monitors, laptops, notebooks, tablets, e-books/e-readers
Category 3
Flat fluorescent lamps, compact fluorescent lamps, fluorescent lamps, high intensity discharge lamps - including pressurized sodium lamps and metal halide lamps, low pressure sodium lamps, LED lamps
Category 4
household appliances, information communication technology and telecommunications equipment, equipment for consumer goods, lighting equipment, equipment that reproduces sound or images, musical equipment, electrical and electronic tools, toys, sports and recreation equipment, medical devices, monitoring and control instruments, automatic dispensers, equipment for the production of electric currents). This category does not include the equipment included in Categories 1, 2 and 3
Category 5
household appliances, consumer equipment, lighting equipment, sound or image reproducing equipment, musical equipment, electrical and electronic tools, toys, sports and recreation equipment, medical devices, monitoring and control instruments, automatic dispensers , equipment for the production of electric currents). This category does not include equipment included in Categories 1,2,3 and 6
Category 6
Mobile phones (smartphones, tablets, etc.), GPS and navigation equipment, pocket calculators, routers, personal computers, printers, telephones
Types of equipment that do not fall into the appropriate category:
Category 1
Ventilation equipment (eg fan, hot air fan, fan coils, etc.), infrared equipment, or water radiators and in general all equipment that uses water without additives or coolants for temperature exchange
Category 2
a) Small ICT equipment, such as mobile phones (smartphones, tablets, etc.), GPS and navigation equipment, pocket calculators, telephones, etc. (as e-equipment is allocated in category 6). b) E-equipment that may contain screens with surfaces larger than 100 cm2, such as some refrigerators, ATMs, body care equipment, industrial machinery, medical devices, printers, photocopiers, etc
Category 3
apparatus which distributes, filters or transforms the light transmitted by one or more lamps and which includes all the parts necessary to support, fix and protect the lamps and, where necessary, auxiliary electrical circuits together with the means of connection to the electrical supply. Luminaires are allocated to category 4 or 5. Luminaires with integrated light sources (which cannot be removed without damaging the unit) are considered as lamps
Category 4
Refrigerated machines (category 1), large screens (category 2), large lamps (long fluorescent tubes) (category 3) etc.
Category 5
Small ICT equipment with an external dimension of less than 50 cm (mobile phones such as smartphones, tablets, etc.), routers, printers, GPS and navigation equipment, etc.) is allocated to category 6
Category 6
Small non-IT equipment and telecommunications equipment (eg mp players, etc.), large IT equipment (large printers) and IT equipment with screens larger than 100 cm2 (laptops, tablets, eBook-/e-Readers etc.) which are in category 2
